You acknowledge and understand that:
- AI features are provided for informational purposes only and do not constitute professional advice

- AI-generated recommendations may be inaccurate, incomplete, or inappropriate for your specific circumstances
- AI systems can generate responses that sound confident and authoritative but are factually incorrect, fabricated, or misleading (sometimes called "hallucinations")
- AI may cite non-existent studies, provide incorrect nutritional data, or give advice that contradicts established medical or nutritional consensus

- AI features are not monitored by human professionals in real-time
- AI cannot examine you, access your complete medical history, or exercise professional judgment
Third-Party AI Technology
Our AI features are powered by third-party artificial intelligence technology, including large language models provided by third-party AI service providers (such as Anthropic). Neither Ascent Health nor our AI technology providers warrant that AI-generated content is accurate, safe, or appropriate for any particular use.

Data Accuracy and Your Responsibility
The accuracy of the information, recommendations, and insights provided by our Services depends on the accuracy and completeness of the data you provide. This includes food logs, body measurements, workout data, and other health information you enter.
If incorrect data is entered into the Services, or if data is entered incorrectly, the results, recommendations, and AI-generated content will be incorrect or inappropriate. Ascent Health is not responsible for any consequences arising from inaccurate data entry.
Calorie counts, macronutrient calculations, and nutritional information are estimates based on available data sources and may not be precise. Actual nutritional values may vary based on preparation methods, portion sizes, ingredient variations, and other factors.

- Cardiovascular events: heart attack, stroke, cardiac arrest, arrhythmia, and sudden cardiac death
- Rhabdomyolysis (muscle breakdown) from overexertion
- Heat-related illness: heat exhaustion, heat stroke, and dehydration
- Exercise-induced asthma or respiratory distress
- Hypoglycemia (low blood sugar), especially when combining exercise with dietary changes
- Falls, impact injuries, and equipment-related injuries
- Aggravation of pre-existing conditions
- Death

Limitation of Liability

- Any errors, inaccuracies, omissions, hallucinations, fabrications, or misleading statements in AI-generated content
- Any health outcomes, injuries, or adverse effects resulting from following recommendations
- Any decisions you make based on information obtained through the Services
- Any failure of AI features to identify risks, contraindications, or dangers relevant to your health
- Any unexpected, unintended, or harmful AI behavior
Assumption of Risk
By using our Services, you acknowledge and agree that:

Release and Waiver of Liability
BY USING THE SERVICES, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Ascent Health Technologies, Inc., its officers, directors, employees, agents, representatives, successors, and assigns (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you while participating in any activity recommended, suggested, or facilitated by the Services.
YOU AGREE THAT THIS RELEASE INCLUDES ANY CLAIMS BASED ON THE NEGLIGENCE, ACTION, OR INACTION OF THE RELEASED PARTIES.
Gross Negligence and Intentional Misconduct
Nothing in this disclaimer shall be construed to release, waive, or limit liability for: (a) gross negligence; (b) intentional misconduct; (c) fraud; or (d) any other liability that cannot be released as a matter of law.
Indemnification
You agree to indemnify and hold harmless Ascent Health Technologies, Inc., and its officers, directors, employees, agents, and affiliates from and against claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your violation of this Health Disclaimer or our Terms of Service
- Your negligent or willful misconduct in using the Services
- Inaccurate information you knowingly provide to the Services
- Your infringement of any third-party rights
- Claims by third parties related to your use of the Services
This indemnification obligation does not apply to claims arising from the gross negligence, intentional misconduct, or fraud of Ascent Health Technologies, Inc.
