Consumer Health Data Privacy Notice

This Consumer Health Data Privacy Notice supplements our Privacy Policy and applies specifically to "consumer health data" as defined under the Washington My Health My Data Act and the Nevada Consumer Health Data Privacy Law.

What Is Consumer Health Data?

Consumer health data includes information that identifies or is linked to a consumer and relates to physical or mental health, including but not limited to:

  • Nutrition and dietary information
  • Fitness and exercise data
  • Body measurements (weight, height, body composition)
  • Health goals and progress
  • Information about physical conditions or symptoms

What Consumer Health Data We Collect

We collect the following categories of consumer health data when you use our Services:

  • Nutrition logs and food diary entries
  • Workout and exercise data
  • Body measurements you provide
  • Health and fitness goals
  • AI coaching conversation content related to health
  • Progress photos (if you choose to upload them)
  • Data received from connected health platforms (Apple Health, Google Fit, wearable devices)

How We Use Consumer Health Data

We use consumer health data solely to:

  • Provide and personalize the Services
  • Power AI coaching features
  • Generate nutrition and fitness recommendations
  • Track your progress toward health goals
  • Improve our Services using aggregated, de-identified data

We Do Not Sell Your Consumer Health Data

We do not sell consumer health data. We do not share consumer health data for cross-context behavioral advertising.

Third-Party Processing

Consumer health data may be processed by third-party AI service providers (such as Anthropic) solely to provide AI coaching features. Our service providers are subject to their own privacy policies and applicable data protection laws. We do not permit service providers to use your consumer health data for their own purposes.

Data Retention

We retain your consumer health data for as long as your account is active or as needed to provide you with our Services. When you delete your account, we will delete or anonymize your consumer health data within 30 days, except where we are required to retain information for legal, regulatory, or legitimate business purposes.

Your Rights

You have the following rights regarding your consumer health data:

Access

You can access your consumer health data through your account settings or by contacting us at privacy@joinascent.health.

Delete

You can request deletion of your consumer health data at any time. To delete your data, use the self-service features in your account settings or contact us at privacy@joinascent.health.

Withdraw Consent

You may withdraw your consent for collection of consumer health data at any time by deleting your account or contacting us. Note that withdrawing consent may affect your ability to use certain features of the Services.

How to Exercise Your Rights

To exercise your rights regarding consumer health data:

  1. Self-Service: Use the data export and deletion features in your Account Settings within the app.
  2. Email: Contact us at privacy@joinascent.health with your request.
  3. Mail: Write to us at the address below.

We will respond to your request within 30 days (or sooner if required by applicable law). We may need to verify your identity before processing your request.

Appeals

Washington Residents

If we deny your request to exercise your consumer health data rights, you may appeal by contacting privacy@joinascent.health with "Appeal" in the subject line. Include a description of the original request and the reason you believe the denial was in error.

We will respond to your appeal within 45 days. If your appeal is denied, you may contact the Washington State Attorney General at www.atg.wa.gov to file a complaint.

Nevada Residents

If we deny your request, you may contact the Nevada Attorney General's Office at ag.nv.gov to file a complaint.

Changes to This Notice

We may update this Consumer Health Data Privacy Notice at any time. We will update the "Last Updated" date at the top of this Notice when changes are made. Your continued use of the Services after changes indicates acceptance of the updated Notice.
